Matters we can help with

Public procurement in Italy: tenders, challenges and contracts

Preparing a bid, challenging an exclusion and delivering a public contract call for different legal assessments. The firm connects its review of the documents with the operational decisions, timetable and commercial interests involved.

  • Preparing a bid and reviewing qualification requirements, reliance on other entities’ capacity and subcontracting.
  • Assessing challenges to exclusion or contract award decisions and the need for urgent relief.
  • Managing price adjustments, penalties, contractual reservations and performance disputes.

How we assist

Preparing and participating in procurement procedures

Reviewing tender documents, eligibility requirements and evaluation criteria. Assistance with clarification requests and administrative documentation, including joint bidding arrangements, reliance on other entities’ capacity, subcontracting, conflicts of interest and required declarations. For public authorities and bodies, legal support in drafting procurement documents and explaining the reasons for award decisions.

Supply-chain compliance and tender documentation

Advice on legality protocols, payment traceability obligations and safeguards concerning contractors, subcontractors and suppliers. Reviewing social clauses, organisational commitments and the evidence needed to demonstrate implementation. The relevance of certifications, ratings and other qualifying elements is assessed against the applicable rules and any award criteria in the individual tender.

Checks, exclusions and contract awards

Assessing eligibility requirements, grounds for exclusion, potentially abnormally low tenders and challenges to the evaluation of bids. Reviewing the scope for correcting administrative deficiencies and obtaining access to documents, including where disclosure must be balanced against confidentiality. The aim is to identify the relevant issue and the available remedy promptly.

Throughout the life of the contract

Assistance in interpreting and negotiating contractual terms and managing disputes, penalties, amendments, price adjustments, reservations of claims, withdrawal and termination. Analysis of the allocation of risks and obligations, with particular attention to ongoing services and supplies for public bodies and healthcare organisations.

Protecting interests in disputes

Assessing administrative and judicial remedies, interim relief and dispute resolution options. Preparing submissions and representing clients before the competent courts, distinguishing issues concerning the award procedure from those arising during contract performance.

Illustrative example

Exclusion from a services tender

A business receives an exclusion decision based on the interpretation of an eligibility requirement. Assistance may include reviewing the tender rules and the submitted application, obtaining relevant documents, checking the reasons given and applicable time limits, and deciding between engagement with the contracting authority and court proceedings. Reconstructing the documentary record allows the position to be assessed before resources are committed to litigation.
